By using this website or placing an order with Discount Gun Mart, you agree to the following statements, terms and conditions:

I am not currently less than twenty-one (21) years of age.
I have not renounced my U.S. citizenship.
I am not a fugitive from justice.
I will not commit any unauthorized export of defense articles including but not limited to firearms, firearm accessories, or ammunition.
I am not an illegal or unlawful alien, and I am not a non-immigrant alien.
I am currently not subject to a domestic violence restraining order of any kind.
I have not been adjudicated as mentally defective and I have not been committed to any mental institution.
I am not an unlawful user or addicted to any controlled substance.
By selling or delivering ammunition, firearms, and/or firearm accessories to me, Discount Gun Mart is not violating any state or local law or ordinance.
I have never been and I am not expected to be convicted in any court of a misdemeanor crime of domestic violence.
I am not under indictment for and have never been convicted in any court of a crime punishable by imprisonment for over one year.
I have never been and I am not expected to be discharged from the Armed Forces under dishonorable conditions.

Cancellations

I understand that Discount Gun Mart’s order system automatically submits my order to the shipping department for picking/shipping and that I cannot cancel an order once placed. I also understand that Discount Gun Mart may cancel my order at any time if I did not abide by the Terms and Conditions. I understand that if I refuse to accept delivery of an order that I placed, then Discount Gun Mart will charge me the full cost of shipping plus a restocking fee of 20%. The "full cost of shipping" is the cost to ship from Discount Gun Mart to your chosen destination, plus the cost to ship back to Discount Gun Mart. I will receive back the remainder of my original payment (minus shipping and restocking amounts, as explained above) as a store credit, not as a refund. Discount Gun Mart reserves the right cancel any order or any item on an order.

Firearm Sales and Shipments

All firearms and ammunition sold will be in accordance with applicable laws.

Firearms purchased on-line may be picked up in a Discount Gun Mart (DGM) store or shipped (transferred) to another federally licensed firearms (FFL) dealer.

If picked up in a DGM store, buyer is subject to all federal, state, and locally mandated requirements including 10 day waiting period, background check and background check fees. Buyers are required to meet age, residency and identification requirements. Please see FAQ for more information.

Shipments to other FFL dealers are subject to federal and state regulations. Receiving dealer is responsible for buyer meeting all applicable delivery and eligibility requirements for purchase.

Federal law requires handgun and receiver only purchasers to be 21 years of age.

Additionally, California law requires all purchasers to be 21 years of age with certain exceptions for long gun purchase.

Ammunition Shipments

Ammunition will be shipped ground to the 48 contiguous US states only.

Shipments to California:

Discount Gun Mart will ship ammunition only to FFL dealers or authorized ammunition vendors in the state of California. Purchaser must arrange for delivery with the receiving FFL dealer or authorized ammunition vendor. Purchaser must contact the receiving FFL dealer or authorized ammunition vendor and request that they email a copy of their license to ffl@discountgunmart.com. Discount Gun Mart will not ship any ammunition until such license is on file.

Discount Gun Mart will not ship ammunition to the following states and locations:

New York
New Jersey
Connecticut
Massachusetts
Illinois
Hawaii
Alaska
New Orleans, LA
Washington DC

Return Policy

In-Store Purchases

You may return / exchange most unused items purchased at Discount Gun Mart within 30 days of purchase, excepting those otherwise restricted in this return policy. Original receipt is required for refund. If no receipt is available, store credit will be issued for the lowest price item sold for in the preceding 180 days. Non-defective items MUST be in new, re-sellable condition, with original packaging & materials to receive full credit, if not, a repackaging / restocking fee of 20% will be assessed. Discount box items are not refundable or exchangeable.

The following items may not be returned or exchanged:

Opened pepper spray.
Any scope that has been installed.
Opened electronic media or software will be exchanged for the same title only.
Firearms that have been picked up and left the store.

Firearm purchases are subject to a $35 DROS cancellation fee if CA Dealer’s Record of Sale background check (DROS) has been submitted and subsequently cancelled for any reason. DROS fees and DROS submission fees are not refundable after DROS is submitted.

Layaway cancellations after 30 days will be subject to a cancellation fee. Please refer to terms and conditions provided at time of sale for specifics. All layaways are subject to these conditions.

Sales of special order items are final and cannot be returned, refunded or exchanged unless unavailable from manufacturer / distributor.

Firearms with DROS background checks that result in an “Undetermined” status will not be delivered. No exceptions. You have two options to proceed: 1) re-submit the DROS at your expense and see if it gives a different result. 2) Provide DOJ with a “Live Scan” electronic fingerprint submission with accompanying DOJ form at your expense to determine firearm eligibility. Any further DROS submissions are at the customer’s expense. For further information, see CA DOJ website.

California Department of Justice DROS fees and DROS submission fees are not refundable after DROS is submitted.

All credit card refunds are posted to the original payment card. Debit cards are refunded via a mailed company check. Cash purchases over $100 are refunded via a mailed company check. Please allow all refunds adequate processing time per policy.

If any part of purchase is paid for by credit card, purchaser agrees to be bound by this policy, superseding the card issuer agreement, and purchaser agrees to pay to card issuer amount posted to purchaser's account.

All firearms unclaimed for over 60 days, including Private Party Transfers, will accrue minimum storage fees of $20.00 per month.

Returned checks are subject to a minimum $45.00 returned check fee.

Purchaser agrees to pay any balance due on purchases; and agrees that DGM retains a security interest in merchandise and ownership of merchandise does not transfer to customer until customer's account is paid in full.

Online Purchases

You may return most unused items purchased at Discount Gun Mart within 30 days of the original delivery. We will pay return shipping costs if the return is a result of our error.

Used firearms shipped to another FFL holder have a 3 day right to inspect. If item is returned as unacceptable, shipping must be prepaid at customer’s expense. No other warranty of any type is implied or given.

New firearms shipped to another FFL holder are non-refundable. All returns of goods shipped to other FFL dealers if approved for return, must have prepaid return shipping and are subject to be assessed a restocking fee of up to 20%.

Online firearm purchases set for delivery through a Discount Gun Mart storefront location are subject to the same terms and conditions as In-Store Purchases (listed above). Unclaimed online purchases not picked up after 60 days are subject to storage fees or resale to another customer unless other arrangements have been made with store manager.

SHIPPING DAMAGE: If the item is damaged in shipping, if possible, notify the carrier at time of delivery with a delivery exception. IMPORTANT: In all instances of shipping damage, all original packaging material must be saved.

If the item is returned for any other reason, you are responsible for the return shipping costs and may be charged a restocking fee of 20%. No returns will be accepted after 30 days. We will credit you in the same manner as your original payment within 7 days of receiving the returned item. Non-defective items MUST be in new, re-sellable condition, with original packaging and materials.

Sales of special order items are final and cannot be returned, refunded or exchanged unless unavailable from manufacturer / distributor.

The following items may not be returned from online sales:

Ammunition - all online ammunition sales are final.
Opened pepper spray.
Any scope that has been installed.
Opened electronic media or software will be exchanged for the same title only.

No returned merchandise will be accepted without a Return Merchandise Authorization (RMA).

After approval, ship authorized returns via prepaid shipping to the shipping address below. RMA NUMBER MUST BE ON OUTSIDE OF PACKAGE OR WILL BE REFUSED.

Shipping and Title

All orders are shipped with "Adult Signature Required".

I understand that I will take legal title to the products in my order once they are delivered to my specified address. I agree that the shipping carrier’s records as to when and where my order was delivered will be definitive and that I am fully responsible for my products once they are delivered.

Warranty

New Product Warranty

All new product warranties are the sole responsibility of the manufacturer. Discount Gun Mart ("DGM") MAKES NO WARRANTY, EXPRESS OR IMPLIED, AS TO NEW PRODUCTS. However, as a service to the original purchaser, DGM will act as the customer's agent with the manufacturer. This includes shipping products to the manufacturer, or the manufacturer's warranty station, at our expense, provided any repairs are covered by the manufacturer's warranty. DGM will provide this service for the period of manufacturer's warranty or for one year from the date of sale, whichever comes first. Defective items that are desired to be covered under the manufacturer’s warranty must be delivered or shipped to DGM at the owner’s expense. Return shipping to customer (if applicable) is also at customer’s expense. DGM MAKES NO OTHER WARRANTY, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTY OF MERCHANTABILITY OR ANY WARRANTY OF FITNESS FOR A PARTICULAR USE OR PURPOSE.

Used Product Repair Policy

Except when sold “AS IS,” or firearms shipped to another FFL holder, used firearms sold by DGM will be repaired for mechanical malfunctions for a period of ninety (90) days following date of sale subject to the following: (i) DGM's liability shall be limited exclusively to repair or replacement (at DGM's discretion) of goods determined by DGM to contain defects in materials or workmanship; (ii) DGM shall be liable for repair or replacement only if notified in writing of such defects by the purchaser within the warranty period and within thirty (30) days after such defect becomes or should have become known to the purchaser, and the replacement or repair work is done by DGM; (iii) transportation charges to DGM shall be paid by the purchaser; and (iv) this warranty shall not apply to any damages to the goods caused in transit or by misuse, neglect, accident, alterations or repairs made by anyone other than DGM. THIS WARRANTY IS EXPRESSLY IN LIEU OF ANY OTHER WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE (INCLUDING WITHOUT LIMITATION FUNCTIONING WITH ANY PARTICULAR TYPE OR BRAND OF AMMUNITION). THE REMEDIES SET FORTH ABOVE ARE THE SOLE AND EXCLUSIVE REMEDIES OF ANY PURCHASER; DGM SHALL NOT BE LIABLE FOR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES.

Tax Notification

I understand that my order may be subject to sales tax depending on where I reside.

E-mail List

I understand that Discount Gun Mart may send me subsequent notices of product specials, sales, and announcements and that by submitting my order, registering for an account, or entering my email on the Discount Gun Mart website, I am agreeing to add my name and e-mail address to the e-mail list maintained by Discount Gun Mart. You may unsubscribe from these emails at any time.

Review Manufacturers' Safety Information

I understand that Discount Gun Mart is a retailer and that product manufacturers are the best sources for information about their products, such as safety warnings, product specifications, and other information. Prior to buying or using products from Discount Gun Mart, I expressly agree that I will review this important information from product manufacturers.

Release of Liability and Agreement to Indemnify and Defend

I fully agree that if any of my representations when making purchases under the Terms of Sale are incorrect or if I fail to comply with these Terms of Sale, then I will indemnify, defend, save harmless, and release Discount Gun Mart and its owners, agents, officers, and employees against any civil liability or criminal prosecution resulting from my purchase from Discount Gun Mart. I fully agree that by placing my order, I release Discount Gun Mart from any and all liability arising from or related to the products I purchased from Discount Gun Mart, including but not limited to my or anyone else’s use of the product, my or anyone else’s storage of the product, and my or anyone else’s handling or transportation of the product, and I agree to indemnify, defend, save harmless, and release Discount Gun Mart and its owners, agents, officers, and employees against any civil liability or criminal prosecution resulting from the products I purchased from Discount Gun Mart.

Class Action Waiver

I expressly agree that any dispute resolution proceedings, including but not limited to, litigation, arbitration, and mediation, will be conducted only on an individual basis and not in a class, consolidated, or representative action. By making this express agreement, I acknowledge and affirm that this is a knowing, voluntary, and permanent waiver of any right to bring federal, state, or local claims as to any part of, or on behalf of, any class or any other individuals, before a court or other tribunal.

Jurisdiction

I understand and agree that if I decide to file a complaint against Discount Gun Mart or any of its owners, agents, officers, or employees that such a complaint must be filed within a court located in San Diego County, California. Furthermore, I agree that any such complaints not filed within San Diego County, California shall be immediately removed to a court within San Diego County, California and I agree to reimburse Discount Gun Mart and any other defendants for the costs of defending against the wrongly filed complaint or effecting its removal. I also understand that any complaint or legal suit I file against Discount Gun Mart, and any purchases I make from Discount Gun Mart, shall be governed solely by California law. This includes any suit filed against Discount Gun Mart by someone else as a result of my purchases from Discount Gun Mart.

WARNING: Discharging firearms in poorly ventilated areas, cleaning firearms or handling ammunition or components may expose you to chemicals known to the State of California to cause cancer and birth defects or other reproductive harm, including: Lead, Hexane, Isopropyl Alcohol, Ammonium Hydroxide, Ethyl Alcohol, Kerosene, Oleic acid, and other substances, from direct contact and inhalation.
